Terms and Conditions of Use for the "EML Voicemail2Text System"

The EML Voicemail2Text System ("Transcription Service") automatically converts voicemail messages into text and comprises the following components:

  • EML Voicemail2Text Service

    A service which transcribes your voicemail messages.

  • EML Voicemail2Text Webseite

    An interface to access the EML Voicemail2Text Service through your browser.

  • EML Voicemail App

    An interface to access the EML Voicemail2Text Service on your smartphone.

Upon registration, you will receive an e-mail address to be used exclusively for our Transcription Service. To use the Transcription Service, e-mail your voicemail message to the aforementioned e-mail address. Our transcription server will automatically convert your voicemail message into text and send the speech recognition results to you in text form.

  3. Use of the Transcription Service

    The Transcription Service is presently offered at no cost for personal use (i.e., not for commercial use) only. Any other use, specifically any commercial use, requires the written consent of EML European Media Laboratory GmbH (e-mail:  voicemail@eml.org).

  4. Acceptance of the Terms of Use
    • By using the Transcription Service, you agree to these Terms and Conditions and to the storage and use of your data ("Original Data") as stipulated below. EML European Media Laboratory GmbH will treat your Original Data as confidential and will not disclose it to any third parties.
    • By using the Transcription Service, you further agree that your data may be used for research and development in speech and language processing. We intend to statistically analyse and anonymise such Original Data ("Anonymised Data"). Once the data has been anonymised, it can no longer be traced back to an individual person.
    • You agree not to use the Transcription Service in an abusive manner, not to interfere with the service and not to access the service in any manner other than through the provided user interfaces and/or platforms we provide.
    • If you breach these Terms and Conditions of Use, we will be entitled to take technical and legal measures to restrict your individual use or to temporarily or permanently suspend your access to the service.
  5. Changes to or discontinuation of the Transcription Service
    • EML European Media Laboratory GmbH is under no obligation to provide this Transcription Service indefinitely at no cost. In turn, you may discontinue use of the Transcription Service at any time.
    • You may revoke your acceptance of these Terms and Conditions at any time by sending an e-mail to voicemail@eml.org Doing so will result in the deletion of your account and Original Data.
    • If you would like to delete your account and your Original Data, you may do so simply by sending an e-mail to voicemail@eml.org.
    • We are continuously improving the Transcription Service, so the service may change from time to time; specific functions or characteristics may be added or removed.
    • The Transcription Service may be temporarily or permanently discontinued for technical or legal reasons, for instance. Particularly in a case where the Transcription Service is being permanently discontinued for financial reasons, we will notify you a minimum of four weeks in advance.
  6. Exclusion of warranty

    EML European Media Laboratory GmbH makes no warranty for the availability of the Transcription Service, its fitness for your intended purposes or the correctness or completeness of the speech recognition results.

  7. Limitation of liability

    You and EML European Media Laboratory GmbH shall be liable for wilful conduct, gross negligence and product defects as stipulated by law. In cases of ordinary negligence, you and EML European Media Laboratory GmbH shall be liable for breaches of material contractual obligations only. In such cases, liability shall be limited to damage which was reasonably foreseeable at the time services were used.

  8. General legal terms and conditions
    • Any amendments to these Terms and Conditions of Use will be made directly on this site so that you are always kept informed of which data EML European Media Laboratory GmbH stores and uses in the course of performing the Transcription Service. The most recent version of the Terms and Conditions of Use shall apply and can be accessed through the Transaction Service website.
    • All rights reserved. No part of this content may be copied without the written consent of the publisher.
    • These Terms and Conditions of Use are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is Heidelberg.
    • Any and all statutory rights to which you are entitled as a user shall not be affected by the present provisions.
    • Should any provision of these Terms and Conditions of Use be or become invalid, either in whole or in part, or should these Terms and Conditions of Use contain an omission, this shall not affect the validity of the remaining provisions thereof. To the extent permitted by law, the invalid provision shall be replaced by a valid provision which most closely reflects the economic intent of the invalid provision; the foregoing shall also apply in the event these Terms and Conditions of Use contain any omissions.
  9. What data is stored when using the EML Voicemail2Text Service?
    • Your voicemail messages and corrections
      • A copy of the voicemail messages you send by e-mail and any corrections you make to the speech recognition results are stored on our computers in our data centres in Germany.
    • Documents (optional)
      • You have the option of uploading data and documents to the EML Voicemail2Text Service in order to improve its speech and language recognition.
      • You may upload data and documents only in those cases where you are authorised to grant EML European Media Laboratory GmbH licence to use such documents as stipulated under §4.
    • Your e-mail address
      • You must provide your e-mail address in order for us to transmit transcribed text.
      • We reserve the right to use your e-mail address to communicate important information to you pertaining to the EML Voicemail2Text Service.
      • Depending on the settings of your e-mail client, we may automatically receive personal data when you send an e-mail to the EML Voicemail2Text Service.
    • Your mobile telephone number (optional)
      • Providing your mobile telephone number enables the EML Voicemail2Text Service to send the transcribed text to that number as a text message (SMS).
    • Additional personal data (optional)
      • Providing additional personal information such as your name and address enables us to personalise messages we send to you.
  10. What data is stored when using the EML Voicemail2Text Website?
    • Anonymous data collected on our web pages
      • Data transmitted by your browser is stored in our server log files. This includes your browser type, browser version, operating system, most recently visited web page and the host name of the computer accessing the site.
      • This data cannot be traced back to any specific individual. Nor is such data combined with any other data sources. The data undergoes statistical analysis and is subsequently deleted.
      • Our web pages use "cookies" in several places. We use such cookies to make our website easier to use, faster and more secure. Cookies are small text files which your browser saves and stores on your computer. The majority of the cookies we use are known as "session cookies". Such cookies are automatically deleted when you are finished browsing. Cookies do not harm your computer in any way, nor do they contain any viruses.
  11. What data is stored when using the EML Voicemail2Text App?
    • Using the reply function:
      • When you use the reply function, we transfer your speech recordings to our servers where they are automatically converted into text. During this process, your recordings are stored on our computers in our data centres in Germany.
      • Your device generates a random number (identifier), which is sent to our computers. This identifier helps us produce a better statistical analysis. At this step in the process, it is no longer possible to link this identifier back to you, your device or your voicemail account. You may generate a new random number at any time.
    • Using the push service:
      • In order to notify the app of new incoming voicemail messages ("Push Service"), a device identifier must be stored on our servers. Each Push Service automatically generates such a device identifier. This identifier does not contain any personal data. It cannot be traced back to you or the type of device you used. If you deactivate the Push Service within the app, this identifier will be deleted from our computers.
      • In order to offer this push functionality, we must notify the Push Service (e.g., Google or Apple) that the telephone with the above identifier may carry out a certain action. We do not share any personal data, account information or portions of voicemail messages at any point in this process. The EML Voicemail App is only notified that it needs to connect to our servers because a new event has occurred.
  12. How is your data used?
    • Your data is used, anonymised and statistically analysed in order to optimise and improve our speech and language processing system.
    • Your data is used for research and development in speech and language processing.
    • Your data shall be treated in accordance with the provisions of German data protection law and will in no case be made publicly available.

You give your consent to these Terms and Conditions of Use by accepting them on the registration form and by using the Transcription Service.

You may not use the Transcription Service unless you have consented to these Terms and Conditions of Use.
